accident, that should be in the process of picked up and moved out of the roadway. southbound along 270, and major tie-ups, and eastbound i-70, approaching 79, is the accident activity. and 270 the to the lane divide, an hour and 20 minutes commute. still busy clearing the accident eastbound on 66 before you reach marshal. traffic remains heavy and slow out of manassas. pretty much to nuttily street with the accident blocking the left lane and rhode island avenue and second street and northeast and remains closed off in each direction due to a crash. that's a check of fox 5 on-time traffic. >> julie, thank you very much. our big story, a huge milestone for the washington nationals. even with the loss to the phillies last night the nats clinched their division for the nl east crown. >> fox 5 jay ross is live at nats park this morning. of course, where else would you be today. dave ross. good morning. >> good morning, allison and tony. this is the place to be. i an it is a little quiet right now. obviously last night, it was

hopping. and it is funny, guys because i know tony you stayed up late and watched the game as well. you got the feeling halfway through, this isn't going so well but that's why the magic number was only at one. just in case the nats didn't win, and the braves lost, it didn't matter how they get there, they've gotten there. so yes, didn't got down exactly the way they wanted it to go, and all of the damage done in the second inning. bryce harper slamming into the wall. there was some concern earlier that harp's soldier might be hurt but he is just fine. adam la roche made the last out when he struck out here. the nats already knew at that point that they had won the national league east. when the braves lost in pittsburgh 2-1. so it was time to pop some bottles and celebrate, and the players talked about this historic accomplishment. >> the whole year was a huge group effort. everyone did so many things to help us get to where we're at

right now. i haven't even thought about being here myself or how long i've been here. some of these other guys, this is great. >> i'm happy for the guys. they've been through a lot. especially guys like jim and everybody else who has been here for so long. and this is fun. this is great. this is just one step. and you know, the celebration gets more and more fun. >> words can't describe, these fan, all game, they were loud, they were so loud and i guess this is what you look forward to in the post season. >> you really do have to feel really good for a guy like an ry zimmerman who has been here since day one. as a matter of fact, when the team started here in 2005, he was basically the face the franchise. he has been here every step of the way. ryan zimmerman and the rest of the guys can wear these 2012nl east championship t-shirts. pretty cool when you think of it when they start and i was down there at the airport for the first ever training camp. frank robinson was the manager and spring training and it felt

a bit like an expansion team. and there is nothing expansion about this team now. this is a full-fledged pennant championship caliber team. as we just found out last night. and i think they're going to give whoever they play in the first round of the playoffs fits even without steven straussberg. >> thaif, dave. let me ask you, to comment on what you were saying because were you there from the very beginng. seven years, not really a long time. it has been a long time for washingtonians over the whole period of decades but for the nationals, seven years, not bad. >> not at all. very quick. when you think about the long suffering cubs fans who have not won anything since the 1910 time frame. and the red sox before, they broke their curse, back in 2004, we're talking about, you know, 50, 60, 70 years. and to do it in seven years, to win a division title, it is really impressive and you have to tip your cap to davey johnson and mike rizzo, the front office, they have done a great job. the warner family.

they've done it the right way. building in the draft. and they did that with guys like steven straussberg. and guys like bryce harper. and going out and trading for geo gonzalez last year who has already won 20 games. they put together the team the right way. and i don't think this is is a flash in the pan. i don't think this is a one-hit wonder. i think the nats will be a player in the national league east for many years to come. >> i think you're right. i think they've done it the right way. still a couple of games left to go in the season, right? >> yes. 96-64. they have two games left. and there is still something to play for. because they're tied right now with the cincinnati reds for the very best record in all of the national league. and if they can best the reds they will be the number one seed and maybe they will have homefield advantage throughout the playoffs. a little quirky system this year. they're going to open up on the road this weekend. either more than likely at atlanta or st. louis, and they will have to play the first two games on the road. they still have homefield advantage, the last three games, if necessary, would all be played right behind me here

anniversary since the beginning of the protesters encampment at mcpherson square. prince george's county police are asking for the public's help in solving a deadly hit-and-run. the victim has been identified as 55-year-old michael eugene white. police believe that white was walking along silver hill road saturday night around 8:30. when he was hit. police say the car was a white chevy impala that may have front end damage. >> police in frederick, maryland, say they are dealing with a violent crime spike that includes the city's first murder of the year. 36-year-old lamont ellis was found dead in an alleyway early sunday morning. he had been shot multiple times. friends and family members gathered at a visual last night. police don't have a suspect nor a motive right now. fox 5 was working the story, conducting interviews at police headquarters, shots did ring out nearby. officers raced to that scene. it turned out to be a street

fight. along west south street. >> it was a mess. it was chaos. there was at least 20 people there, and they had five or six of them, started to break out in a fight. and everybody just started to join in. >> police say one person was stabbed. and is listed in serious condition. no word if the two incidents are related. >> 10 years ago today, our region was traumatized by a sniper shooting spree. the beginning of it. for three weeks in october of 2002, people around our area did not know where the next victims would be shot. john allen muhammad and lee boyd malvo were found guilty of killing 10 people and injuring three others. on thursday there is a prayer vigil to remember the victims. it starts at 6:30 at the goshen united methodist church in gaithersburg. 7:10 right now. 66 degrees on a tuesday morning. and the race for the white house, well, that clock is ticking. ticking.

making headlines this morning, officials say six crew members have been arrested for a deadly boat collisions and being questioned for endangering people's lives according to china's police chief. at least 37 people were killed

and dozens more injured after a boat carrying utility workers collided with a ferry. the boat began to sink immediately following the crash. the boat was carrying 120 people when that crash occurred. the president of iran is back in his country after attending the u.n. and meetings of the general assembly in new york. but his cameraman is not with him. he has applied for asylum in the united states. the cameraman for iran's president now has a lawyer who is working with the state department. and says the camera plan is in hiding and is afraid -- cameraman is in hiding and is afraid of being persecuted because of his political beliefs. more trouble for american airlines. the company is inspecting passenger seats on eight of its boeing 757 jets. after a row of them came loose mid flight on two planes in the last three days. the federal aviation administration said both planes had recently undergone maintenance work that required seats to be removed and reinstalled.

here. kids have not headed out the door yet. they will be wanting to be ready for wet weather. some areas have not seen a whole lot overnight but i can pretty guarantee most of us will get a little something today. rain showers, generally heaviest all morning long. on the western side of washington. so as you get out towards reston and gainsville there, out at 66, we have more showers approaching and some showers will be pushing through washington and then points east, during the course of our morning, as we're dealing with -- here is the good news, if you want the warmer air, we have warmer air moving in as we speak. and our high temperature later this afternoon, it should top out in the mid-70s. there is the larger picture for you. and look at the shower activity back into virginia and the carolinas. all of that is going to get drag dragged up through the mid atlantic, with an area of low pressure currently across central kentucky to push to the great lakes and drag with it all of the moisture. so lots of clouds for your tuesday. showers on and off. it is not going to rain all day today but we will definitely have some periods of rain

washington parkway, the crash at powder mill is gone. and overall, 32 to powder mill, a 22 minutes ride at this time. northbound new hampshire avenue at 29, heads up headed out to white oak. 37 minute commute on i-70. leaving 32 to 695 where we had the crash at the rogers road overpass. be careful there. southbound 270, gridlocked with traffic. nothing but red coming southbound buckiestown to the split. an hour and a half commute with. all lanes open. crash in marshal has cleared but eastbound 66 well below speed. 234 south out of manassas to the beltway, an hour and 12 minute commute there. a slow go for those traveling inside of the beltway. traveling to clara barton parkway at the chain bridge. a crash at this location. kenillworth avenue you remain slow from benning to pennsylvania avenue. that's a check of your fox 5 ontime traffic. >> julie, thank you very much. 7:19. in pennsylvania, today, a judge is expected to rule on a tough new voter identification law that requires everyone to show a picture i.d. at the polls. supporters say they fear

span almost an entire month. >> that stage at the university of denver is still being set for the first debate which will focus primarily on domestic issues. >> this is barack obama. how are you? >> president obama made some quick phone calls at a campaign office in nevada where he is going through debate rehearsals. >> basically they're keeping me indoors all the time. it is a prank. they are making me do my homework. >> part of that homework involves mock debates. the president taking on massachusetts senator john kerry while romney's partner is ohio senator rob portman. in the meantime, most of the public appearances and attacks before the debate are being handed off to the number twos. paul ryan and joe biden hit the trial while their bosses brush up. >> and while this first debate is focused primarily on domestic issues, foreign policy is playing a much larger role out in the campaign trail. especially in the wake of the attack on the consulate in libya.

lunch just got a little more expensive at dc's food trucks. the owners had always played a flat $1500 tax but now the city is implement can the sales tax act and food trucks are no longer immune from that. they have to charge 10% on every sale. the tax went into effect yesterday and while most customers were not happy about the extra fee, it didn't seem to impact the number of people lining up for food. well the holiday sales forecast is out. it is not particularly encouraging news for retailers. the national retail federation says it expects sales during the winter holiday season to rise 4.1% this year. but that's a percentage point lower than growth in each of the past two years. in fact, it is the smallest increase since 2009. but still, it is some growth. still ahead, a closer look

that's a check of fox 5 on-time traffic. fic. maryland voters have a number of important issues to vote for. come november 6. among them, question seven. we've all seen or heard the commercials, but what exactly is question seven? it is hard to know what to believe by the competing ads. take a look. >> question seven will mean hundreds of millions of dollars for schools, from gaming revenues that would have gone to other states and independent audits will guarantee the money goes where it is supposed to. >> on education, the examiner says, quote, school spending in maryland won't increase. and the capital agrees. the sun conclude, quote, question seven is a bad deal for maryland. check the facts for yourself. vote no on question seven. >> well, we are taking a closer look at the issue this morning. joining us with more insight is neil bergman, the director of maryland budget and tax policy institute. man we're glad you're here today. we're glad you're here today.

first of all, just those ads, they sort of, you know, put up against each other, you can just see the message, it is clearly, you know, opposed, and tell us what -- when we're watching those, what to believe and what to take from that. >> the first thing to remember is that the money behind those ads are the competing casino owners. >> okay. >> so they are really fighting to put their customer base and their market share. and they're looking for the arguments that will try to persuade us to vote their way. but of course, there are important facts behind these ads. now, the one we just saw talked about money for education. or whether there is no money for education. if the voters approve this referendum, there ill eventually, 2016, 2017, be close to $200 million that goes into something called the education trust fund. >> okay. >> and all of that money will go to local schools in

maryland. but the total amount doesn't have to go up. so the state can just take back tax money that it would have used because it has the casino money instead. >> okay. >> so what is then the -- what should we really believe about education money in maryland, or is there just no way to know? >> so the casinos, if they expand, will send more money to the states. >> they will, okay. >> and that money could be used to increase education. or it could be used for other good things that the state does. >> right. now, if that money, we're going to get into it more but if the money doesn't go for that, where will all of that excess money go? it just goes into a general fund? what has to happen then to that money? >> so again, all of the money will go to the education trust fund, and will go to local schools. but the state may then use some of the money it saves, because it doesn't have to use tax

dollars for that school aid and use that for health care and public safety and parks and other good things that we depend on from the state. so it helps the state treasury, it will help to balance budgets. but it is wrong to say ha it will increase education aid dollar for dollar. >> and we should also say that the maryland budget and tax policy institute is a totally nonpartisan group. you're just stating the facts and what you think. have you taken a position, has the organization taken a position on it or not necessarily? >> so we haven't taken a position, whether you should vote yes or no. we do think you should vote. so inform yourself. and vote. we also -- you know, your vote yes or no on this referendum is kind of a blunt instrument. your senators and delegates don't know what you mean if you vote yes or vote no. so you should spend time to contact them and send an e-mail or facebook post and tell them

why you voted yes or no. >> where you want the money to go. >> let's talk about the jobs. it says it will create thousands of jobs. is that true? and do those jobs have to stay within the state of maryland? will marylanders benefit from those jobs? >> i mean like any business that oppose, opens, there will be jobs and hundreds of thowfses of jobs for this proposed casino for prince george's. whether those jobs will be net new jobs or whether they will just be casino jobs, instead of movie theater or hospital jobs that would have existed otherwise, it is hard to say. but really, that is true with any economic development. >> the construction aspect in it though, is there anything that says that those jobs have to stay local? >> no, so the construction contractor will advertise and hire, and many of the employees will be maryland residents. many might come from dc, virginia, pennsylvania, west

making headlines in the day ahead, the dc council takes another shot at budget autonomy. today council member phil mendleson will introduce an amendment that will create a voter referendum on the issue. if it passes the city can pass local -- spend local tax dollars without congressional

approval unless the white house intervenes. an average american family might have to shell out $2,000 more in taxes next year if congress doesn't do anything about the fiscal cliff so- called. some $600 billion in tax hikes and government spending cuts are due to take effect in the new year because the bush tax cuts are expiring. and for other reasons as well. and american airlines will reinspect 10, 757s after two separate incidents in which passenger seats came loose in mid flight in the last three days. no injuries were reported any of the times. but the faa says both planes had recently undergone maintenance work that required seats to be removed and reinstalled. we're about to show you, it this is pretty cool. this is breast cancer awareness month. as a show of support, some global icons are going pink. >> take a look. last night, the white house lit up in pink lights.

a massive collision between an amtrak train and a big rig truck leaves nearly two dozen people injured. among them, a newborn baby. this happened in hanford california yesterday. investigators say the big rig driver failed to see the train coming. they are working to determine whether the crash was caused by driver error, a malfunctioning crossing arm, or something else. finally, a rescue operation continues in hong kong. after a boat with over 100 people on board went down after colliding with a tugboat. many were families heading to wash a fireworks show celebrating china's national holiday. 37 people are dead. dozens were rushed to the hospital. and this morning, six members of the crew are under arrest, charged with unsafe operation of a boat. >> that is sad news there. >> yes, it is. it is 8:31 right now. tucker barnes with us again with another look at our tuesday weather. >> yes, it looks like a wet one. in fact it is already wet overnight. we've had heavy rain, wow, i'm

in business now. locally. and just in the past half hour. so we had pretty heavy rain move right inside the beltway here, across the district. and you can see that, heavy rain shower activity. generally washington and points west. so as you get out towards great falls and reston and potomac, pretty good rain showers at the moment. and just to the north and west of the city up to bethesda as well and the north side of the beltway. if you're traveling here, over the short term, i'm afraid the roadways are going to be on the slow side here with all of the rain falling on the west side of the beltway. off to the south and west. to warrenton, and we're still getting pretty good rain and it is just going to back and fill all day today. let's switch maps. what is happening, a lot of moisture working up from the south. let's switch maps. and as we can see here, across the carolinas, a look at all of that cloud cover, and rain shower activity, down towards southern virginia, and north carolina. and so all of this will be streaming north later today, and not going to rain all day today but a lot of cloud cover, with kind of on again offagain rain showers. here is the good news, if you like the warmer temperatures,

they're on the way and the highs later this afternoon should be back in the mid-70s. and future cast, i will put it in motion for you and you can see the hit and miss variety of showers later this afternoon. sunshine late this afternoon, for a few of us and then the rain showers kind of fill in later tonight and with us overnight tonight. as we get into tomorrow morning, we will get glad ule clearing, and by tomorrow afternoon, temperatures back in the 80s. there is the seven-day forecast, 76 today. and low 80s tomorrow. thursday and friday look great with sunshine and highs near 80. and not a bad start for the month of october. hang in there after today. that's a look at weather. allison, over to you. >> tucker, thank you. ♪ >> a new study shows giving kids certain antibiotics is linked to an increased risk of developing inflammatory bowel disease. fox medical team's doctor mike cerigliano joins us live from the city of brotherly love. good morning. and which antibiotics are we talking about here? >> well, basically, allison, what we are finding is that in

this study, with things like penicillin and tet cycline, all of the antibiotics that can kill bacteria known as an arobes, they don't need oxygen to grow, so what they found in the study was that in little kids, especially under the age of one, if they were given an antibiotic for whatever reason, they had a five-fold increased risk of developing inflammatory bowel disease, also known as crohn's disease or ulcerative colitis which can have significant life-long consequences, and can really be a serious condition. >> that sounds really dangerous. and i know those diseases, and they are painful and lifelong. so first i got to ask you, what kind of levels are we talking about? is it just taking too much? can we occasionally do this? would you say don't do it at all if you're under one? what is the advice, dr. mike?

>> look, allison, antibiotics save lives every day. and what the key take-home message here is, you have to be judicious in your decisions to take antibiotics. if you and your doctor, your nurse practitioner, your health care provider, decide, hey, this really requires an antibiotic, then you have to do it. what i find in my practice, and i've been in practice as an internist for 20 years, people will come in, this is not just kids, adults as well. with a viral syndrome, and they insist upon getting an antibiotic. as if it were candy. and so what we need to do, and the take home message here is, especially with your little kids. you need to be very, very careful. now, some people might be saying, well what's the connection? what happens, i brought my friend bob with me, and you take an antibiotic, and the antibiotic kills the bad bacteria that we're all trying to kill but it also kills good bacteria. and the theory is, is that

somehow the inflammation that occurs in the intensens from that change in bacteria leads to and perpetuates the risk for developing inflammatory bowel disease. >> okay. let's switch quickly to another topic. children and those video games. not all bad news, right? some of the games can help some of our kids get moving. >> i love this story. basically, what it is all about is they did a study looking at kids with interactive exercise video games. and they found that their metabolism went up by 100%. they could lose up to a pound a week, if they did it for about one or two hours a day. and what i love about this, is the fact that we are tackling something that is going to make children live less long than their parents for the first time in history. and obesity is a major epidemic. and a crisis in this country. >> i agree totally. we have 30 seconds, dr. mike. vice president d, we mow it is

all i found was champagne all over. i felt like one of the bubbles. i was so excited for the team. i think it was the first time i've ever had a really good time at a washington nationals loss. >> oh, that's right. >> they lost. but we won. >> right, right. how big of a deal is this historicfully speaking? >> well, i joined the washington senators as their stadium announcer in 1956. >> uh-huh. >> all i knew was losing. >> wow. >> the senators first in war, first in peace, last in the league. and so that was true. so being with the nationals, they're winning. it is a really unusual feeling. >> what happens? i sat with the learner family yesterday, watching the game. and for seven innings, we were

there. and you're right. they're doing it with the help of city blossoms. this is lola and rebecca, the co-founders and co executive directors of city blossoms. good morning to you all of you. it smells like an italian restaurant in here. because they're learning to make pesto. but you know what? the whole farm to school month works so nicely, with your garden to classroom theme that you've been doing for a long time. >> absolutely. we've been working with kids since the late 90s. but city blossoms officially became a nonprofit in 2009. and we work with over 16 different locations in the city. >> and kind 6 6 -- of give me an idea of exactly what you do with the schools. >> depending what the schools need we like to come in and help to build a garden or work a garden they already built and we teach nutrition classes from produce from the guarden. >> we have some pictures from the garden as it was nicely watered this morning and how do you decide what to grow and what are the kid's responsibles in terms of caring for the

guarden. >> the kids come out every single week and cake care of the garden. -- take care of the garden. watering, mulching, and we ask the parents and the kids what they want, and what the teachers want. and each year we change it up a little bit. basele is always really popular. and we have a ton of it. and something that is really popular right now, at dc by lingual is swiss chard. >> really? >> isn't that interesting? so then they get to go out there and they take care of the plants and see them grow. then they get to turn them into something. so rebecca tell bus this wonderful pesto -- tell bus this wonderful pesto recipe have you go here. >> we like to use mortar and pestles in class because we don't have to do too much cooking. where did we grab the basil from? >> the guarden. >> parmesan cheese. and pumpkin seeds. and then a little olive oil. to mix it up. >> i thought you used pine nuts in pesto. >> because in a lot of schools, nuts are usually things that we

don't bring in too much because of allergies, we started using seeds. and then that also lets us talk about seeds in class and stuff which makes sense for the guarden. >> do you find that the kids, this is a relatively simple recipe, something they can do at home as well. do you find they're pretty receptive. are youwhat you're learning? >> what does that mean? >> a lot of times we have parents coming back saying why is my kid asking to make this kind of pasta salad at my house? why do they want to eat beets now? and we have to make sure we have copies of the recipes to send home with the families. >> when i was reading about you all, you encourage people to start their own garden at home. and one of the best ways to do that is to go to the nursery and let your child pick out the seed pact that appeals to them. >> absolutely. or little plants. right now great plants to get for the fall are lettuce, spinach, and swiss chard. again. >> and you guys are also in addition to working with schools, don't you have some programs, a ball bash coming up. >> october 27, weal will have the annual bald bash at marion street garden with a huge
